UHHRU expert at the Military Institute: the role of a military lawyer during the armed conflict in Ukraine

Two-week marathon of presentations on non-governmental sector activities on overcoming the consequences of the armed conflict has ended.

On July 20, 2018, in the framework of the marathon, UHHRU lawyer Maksym Tymochko held a lecture for lawyers of the Armed Forces of Ukraine at the Military Institute of the Taras Shevchenko National University of Kyiv. The lecture was entitled The Role of a Military Lawyer during the Armed Conflict in Ukraine. New Goals and Challenges.

A number of issues was discussed during the lecture, related to domestic military law as well as application of international humanitarian law during the armed conflict in Crimea and eastern Ukraine. The UHHRU expert invited the participants to solve several practical problems, which, on the one hand, reveal existing issues in the national legislation of Ukraine, and on the other, help consolidate the knowledge gained from IHL.

Thus, one of the problems involved an unconventional and rather complicated situation which any military lawyer may face in the course of the fighting at the demarcation line. While solving this problem, the participants saw for themselves the gaps and contradictions of Ukraine’s legal system, which is not properly adapted to the conditions of the armed conflict.
